Privacy Policy for Meyat Engineering

Meyat Engineering ("we," "us," or "our"), a holding company for Meyat Software, Meyat Electrical, and Meyat Audio Visual, is committed to protecting the privacy of visitors to our website. This Privacy Policy outlines how we collect, use, disclose, and safeguard your personal information in compliance with the Protection of Personal Information Act (POPIA) of South Africa. By using our website, you consent to the practices described in this policy.

2. Purpose of this Policy

This policy aims to inform you, as a data subject, about how we process your personal information, as required by Section 18 of POPIA. We are committed to transparency and accountability in our data processing practices.

3. Definition of Personal Information

"Personal information" means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to:

  • Name, identity number, symbol, e-mail address, physical address, telephone number, location information.
  • Information relating to the education, medical, financial, criminal or employment history of the person.
  • Any identifying number, symbol or other particular assigned to the person.
  • The biometric information of the person.
  • The personal opinions, views or preferences of the person.
  • Correspondence sent by the person that is implicitly or explicitly of a private or confidential nature.
  • The views or opinions of another individual about the person.
  • The name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person or if the disclosure of the name itself would reveal information about the person.

4. Information Collection

We collect personal information in the following ways:

  • Contact Forms: When you fill out a contact form, we collect your name, email address, phone number, project requirements, and any other information you provide. Specific fields include: Name(s), Email address, Phone number, . This may include sensitive data related to project needs.
  • Analytics: We use Google Analytics and Vercel Analytics to collect information about your interactions with our website, including your IP address, browser type, operating system, pages visited, time spent on our site, demographics, and interests.
  • Google reCAPTCHA: We utilize Google reCAPTCHA to prevent spam and abuse. This service may collect data about your interactions with the reCAPTCHA widget, including mouse movements and keystrokes.

We use the collected information for the following specific purposes:

6. Legal Basis for Processing (Conditions for Lawful Processing - Section 11 POPIA)

We process your personal information based on the following legal bases:

  • Contractual Necessity (Section 11(1)(b)): To fulfill obligations related to services requested.
  • Legitimate Interest (Section 11(1)(f)): For website analytics and improvement.

7. Sharing of Information (Further Processing Limitation - Section 15 POPIA)

  • Attorneys and other persons that assist with the enforcement of agreements.

  • Law enforcement and fraud prevention agencies, and other persons tasked with the prevention and prosecution of crime.
  • Courts of law or tribunals that require the personal information to adjudicate referrals, actions or applications.
  • Persons to whom we have ceded our rights or delegated its obligations to under agreements, such as where a business is sold.
  • Our partners with whom we have concluded business agreements.

8. Processing of Special Personal Information

Special personal information may be processed by Meyat Engineering in the following circumstances:

  1. if you have consented to the processing or if the special personal information was made public by you;
  2. if the processing is required by law and if the processing is needed to create, use or protect a right or obligation in law;
  3. if the processing is for statistical or research purposes, subject to all legal conditions being met;
  4. if health information is processed, and the processing is to determine your insurance risk, or to comply with an insurance policy, or to enforce an insurance right or obligation.

The personal information of children will only be processed by Meyat Engineering if any one-off the following applies:

  1. a person with the ability to sign legal agreements has consented to the processing, being the parent or guardian of the child;
  2. the processing is needed to create, use or protect a right or obligation in law, such as where the child is a beneficiary of an insurance policy or an insured person in terms of an insurance policy;
  3. the processing is for statistical or research purposes and all legal conditions are met.

9. Data Security (Security Safeguards - Section 19 POPIA)

We have deployed and implemented security measures to protect against the loss, misuse or alterations of the Information under our control, by unauthorized third parties. We are committed to providing secure services.

When we contract with third parties, appropriate security, privacy and confidentiality obligations are imposed on them to ensure that personal information is kept secure.

We regularly test the effectiveness of the security of our systems and respond to any threats that may be detected.

No data transmission over the Internet can be guaranteed to be 100% secure, and Meyat Engineering does not warrant that your information will be secure but confirm that all reasonable security safeguards will always be in place.

We implement reasonable security measures to protect your personal information, including:

  • SSL/TLS encryption for data transmitted over our website.
  • Access controls to restrict access to personal information to authorized personnel.
  • Regular security audits.
  • Data breach procedures, that will notify the information regulator and effected parties.

10. Data Retention (Restriction on Retention of Records - Section 14 POPIA)

We will retain your personal data for as long as it is needed to fulfil the purposes for which it is collected, and this information is required for lawful purposes related to our functions and activities.

Specific retention periods include:

  • Contact form data: 24 months.
  • Analytics data: 14 months.
  • Data required for legal compliance: As long as the law requires.

11. User Rights (Rights of Data Subjects - Chapter 3 POPIA)

Under POPIA, you have the following rights:

  • Right to Access (Section 23): You have the right to request a copy of the personal information Meyat Engineering holds about you. This includes requests pertaining to:
    • Confirmation that Meyat Engineering holds your personal information.
    • A copy of the record containing your personal information.
    • The identity of third parties who have and had access to your information.

We will need a copy of your ID document to confirm your identity before providing details of your personal information.

Please note that any such access request may be subject to a payment of a legally allowable fee.

Please refer to our Promotion of Access to Information Act 2 of 2000 Manual (PAIA Manual) for further information on how you can give effect to the above listed rights. The PAIA Manual is located on the Meyat Engineering websites.

  • Right to Rectification (Section 24): You have the right to ask us to update, correct or delete your personal information if it is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, obtained unlawfully, or if we are no longer authorized to keep it. You must inform us of your request in writing.
  • Right to Object (Section 11(3)): You can object to the processing of your personal information.
  • Right to Erasure (Deletion) (Section 24): You can request the deletion of your personal information.
  • Right to Lodge a Complaint (Section 74): You can lodge a complaint with the Information Regulator.
  • Right to withdraw consent: Where processing is based on consent, you may withdraw your consent at any time.

12. Cookies and Tracking Technologies

We use cookies and similar technologies.

Cookies are small pieces of data that allow the Meyat Engineering web server to recognize you. Apart from merely establishing basic connectivity and communications, Meyat Engineering may use this data to develop customized services that may be tailored to your individual interests and needs. 13. International Data Transfers (Transborder Information Flows - Section 72 POPIA)

Meyat Software operates internationally. Therefore, your personal information may be transferred to and processed in countries outside of South Africa.

We will only transfer your personal information to third parties outside the borders of South Africa in any of the following circumstances:

  • where your personal information will be adequately protected under the other country's laws or an agreement with the third-party recipient;
  • where the transfer is necessary to enter into, or perform under a contract with you or a contract with a third party that is in your interest;
  • where you have consented to the transfer; and/or
  • where it is not reasonably practical to obtain your consent, and the transfer is in your interest.

The Personal Information shared will be limited to the information required to fulfil the products and services, and the transfer will happen within the requirements of the law.

We will ensure that the party processing your personal information in the other country will agree to apply the same level of protection as available by law in your country, or if the other country's laws provide better protection, the other country's laws would be agreed to and applied.

We implement appropriate safeguards, including standard contractual clauses, to ensure the protection of your data.

14. Processing of Personal Information for Direct Marketing Purposes

Meyat Engineering may use your Personal Information to send you information on new services or products that may be of interest to you and from time to time will call, mail, email or SMS information to you about Meyat Engineering, our products and services, or our partners and their products or services.

If you are not a Meyat Engineering customer, or in any other instances where the law requires, Meyat Engineering will only market to you by electronic communications with your consent.

If you do not wish to continue receiving this information, you may contact Meyat Engineering and we will remove you from our mailing list.

We will only send you marketing communications if you have "opted in" to receiving such communications. You have the right to "opt out" of receiving marketing communications, whether by email or otherwise, at any time.

Meyat Engineering will only share your personal information if any one or more of the following apply:

Meyat Engineering reserves the right to amend or modify its Privacy Policy at its sole discretion, at any time, without any prior notice to the User, in response to meeting legislative requirements and dynamic business needs.

All amendments to the Privacy Policy will be posted on the Meyat Engineering websites.

Unless otherwise stated, the current version shall supersede and replace all previous versions of this Policy.
